This Bill would make it illegal for Schools that received Federal funding to seclude and restrain children with disabilities. Prohibits Secluding a child or the use mechanical restraint, chemical restraint, or prone, supine, and any physical restraint that restricts breathing, stops blood flow to the brain, or is life threatening. These practices do not remediate and further traumatizes children. In physically restraining a child it would only be allowed in the circumstances to protect self or others from imminent danger of serious physical injury. The child’s Individualized Education Program (IEP) would not include such practices and parents would have a right of action in the instance of unlawful seclusion or restraint. Most importantly, the bill would make funds available to provided educators and school personnel with the needed supports and training they need to address school-expected behavior with evidence-based strategies.
